iTutorzz — Terms of Service (ToS)

These Terms of Service (“Terms”) govern your access to and use of the iTutorzz online tutoring platform (“iTutorzz”, “we”, “our”, “us”). By creating an account, purchasing lessons, enrolling a child, or teaching through iTutorzz, you agree to be bound by these Terms.

iTutorzz operates as an international online tutoring platform that connects students (“Students”) with employed tutors (“Tutors”). Lessons are delivered online and managed through the iTutorzz web portal and designated communication channels.

1. Definitions

• “Platform” refers to the iTutorzz website, portal, tools, communication groups, and related services.

• “Student” refers to any individual receiving tutoring services.

• “Parent/Guardian” refers to the legal adult responsible for Students under 18.

• “Tutor” refers to an educator contracted by iTutorzz and compensated based on teaching hours.

• “Class” or “Lesson” refers to a scheduled tutoring session conducted online.

• “Makeup Credits” refer to credits issued for eligible canceled classes.

2. Eligibility

• Students under 18 must have a parent or legal guardian handle registration, communication, and payment responsibilities.

• Tutors must meet iTutorzz qualifications and agree to internal tutoring guidelines.

3. Role of iTutorzz

• iTutorzz provides scheduling, lesson management, tutor assignment, and payment processing.

• iTutorzz employs tutors on a non-fixed-salary basis — tutors are paid only for the hours they actually teach.

• iTutorzz is not liable for internet issues or device failures on the Student or Tutor side.

4. Student & Parent Responsibilities

Students/parents agree to:

• Attend classes punctually.

• Notify iTutorzz through the designated WhatsApp group at least 30 minutes before class time to delay, reschedule, or cancel.

• Ensure a stable internet connection and appropriate learning environment.

• Use the Platform respectfully and refrain from inappropriate conduct.

Attendance Rules

• Classes where both tutor and student attend are marked Present.

• Absence with prior notification → class is not billed and may be rescheduled.

• Absence without prior notification → class is billed; no makeup credit is given.

• All absences reported after class start time are treated as absence without prior notification.

• If a student does not join within 20 minutes, the class is marked as “Absent without prior notification.”

• If a tutor is absent, the class will be rescheduled and makeup credit will be provided.

5. Tutor Responsibilities

Tutors agree to:

• Mark attendance accurately and include required notes for student absences.

• Give at least 2 hours’ notice before delaying or canceling a class.

• Report student absence within the first 5 minutes and wait at least 20 minutes before marking a no-show.

• Provide extra time to complete a full session if they join late.

• Follow all internal tutor guidelines and communication protocols.

Tutor Payment & Penalties

• No payment is made for classes canceled by the student with prior notification.

• 25% payment is provided for student no-shows if the tutor follows proper reporting rules.

• No payment is made for classes the tutor cancels (with or without prior notice).

• A 20% deduction from the next class applies if a tutor is absent without prior notification.

6. Class Scheduling & Rescheduling Policy

6.1 Student-Requested Rescheduling

• Must be requested 30 minutes before class start time.

• Makeup classes must be completed within the same month.

• A maximum of 3 classes may roll over to the next month if needed.

• Makeup credits expire after 30 days.

6.2 Tutor-Requested Rescheduling

• Must be requested 2 hours before class start time.

• All such classes are rescheduled without cost to the student.

• Makeup credit will be provided if needed.

7. Billing & Payment Policies

iTutorzz offers two billing models:

7.1 Monthly Subscription

A recurring monthly fee covering a fixed number of lessons.

7.2 Per-Class Billing

Payment for each individual lesson.

7.3 Billable Lessons

A class is considered completed and billable when:

• Both tutor and student attend,
  and

• At least 75% of the scheduled lesson duration is completed.

7.4 Non-Billable Lessons

Students are not charged when:

• The tutor is absent.

• The student cancels with prior notification.

8. Refund Policy

Refunds are allowed only under specific circumstances:

8.1 Tutor Replacement Refund

If a tutor leaves and the replacement tutor is unacceptable to the Student/Parent, iTutorzz may offer:

• A partial refund for unused lessons,
  or

• Transfer of remaining credits to another tutor.

8.2 No Refund for Completed Lessons

Lessons where both tutor and student attend at least 75% of the lesson duration are non-refundable, regardless of service satisfaction.

8.3 Credit Expiry

Unused credits expire after 3 months.

9. Code of Conduct

All users agree to:

• Treat others with respect.

• Refrain from abusive, harmful, or inappropriate behavior.

• Avoid sharing violent, hateful, or sexual content.

• Respect privacy and confidentiality at all times.

• Use the platform for lawful and educational purposes only.

10. Intellectual Property

• Lesson materials provided by tutors or iTutorzz remain the property of iTutorzz unless otherwise stated.

• Students may use materials only for personal educational purposes.

• Recording lessons without explicit prior consent from iTutorzz and the Tutor is prohibited.

11. Disclaimers

• iTutorzz does not guarantee specific academic results.

• iTutorzz is not responsible for issues caused by user devices, internet failures, or third-party services.

• Students and parents are responsible for ensuring the student’s availability and participation.

12. Limitation of Liability

To the maximum extent permitted by law:

• iTutorzz shall not be liable for indirect, incidental, punitive, or consequential damages.

• Total liability shall not exceed the amount paid by the Student in the 30 days preceding the claim.

13. Termination

iTutorzz may suspend or terminate accounts for:

• Repeated absences or non-compliance.

• Abuse toward tutors or staff.

• Non-payment.

• Violation of any part of these Terms.

Students/parents may discontinue services at any time, subject to the refund policy.

14. Governing Law

These Terms are governed by the laws of the jurisdiction in which iTutorzz is legally registered.
